Conditions of entry for the prize draw

§ 1 Conditions of Participation
Participation in the prize draw is only possible subject to these conditions of participation. The organiser of the prize draws is the

The prize draw has no connection to Facebook and is in no way sponsored, endorsed or organised by Facebook. The recipient of the data and information provided by the participant is not Facebook, but Mondpalast von Wanne-Eickel GmbH & Co. KG.

Eligibility to Participate
Eligible to participate are persons resident in Germany who are at least 18 years of age at the time of participation and are a Facebook “fan” of the Organiser. One becomes such a fan by clicking the “Like” button on the Organiser's Facebook page. Employees of the Organiser are excluded from participation.

By participating, the participant (hereinafter referred to as the participant) agrees to these conditions and further agrees that in the event of winning, their name and/or picture may be published on the internet. Participation is only possible within the specified period. Legal recourse is excluded.

§ 2 Prize and Participation
The respective prize will be drawn among all participants. Sharing the post is not a prerequisite for participation. Participation generally takes place by clicking the “Like” button under the respective post or by commenting on the post. Any special participation options will be indicated in the context of the respective prize draw where applicable. The winners will be determined at random. Alteration or cash payment of the prize is excluded. If the winner does not contact us within one week of the publication of their name, or in the case of prize draws taking place less than one week after the end of the prize draw, no later than 48 hours before the event, the prize shall be forfeited without replacement. The prize cannot be exchanged.

Having previously been a guest of the Organiser or using the Organiser's services does not increase the chances of winning.

§ 3 Liability
Claims for damages in connection with the prize draw against the Organiser are excluded, unless the Organiser has breached obligations intentionally or through gross negligence. The Organiser shall not be liable for damages resulting from the impaired availability of the prize draw website due to technical faults and events beyond its control, as well as attacks by third parties against the prize draw website. Nor does the Organiser assume any responsibility for ensuring that the respective page is correctly displayed on the participant's device.

§ 4 Data Protection
Within the scope of the prize draw, the Organiser ensures the highest possible standard of data protection and complies with all relevant legal provisions. The Organiser will not forward any personal data to third parties or trade in such data. The storage and processing of data shall take place exclusively for the purpose of the prize draw. By participating, the participant hereby declares their consent to the storage and use of the personal data provided for the purpose of participating in the prize draw. Upon termination of the prize draw, the data will be deleted by the Organiser. You can read our privacy policy here.

§ 5 Place of Jurisdiction
German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the registered office of the Organiser is agreed as the place of jurisdiction. Insofar as the participant has no registered office in Germany, the registered office of the Organiser is likewise agreed as the place of jurisdiction.

§ 6 Determination and Transmission of Prizes
The winners will be drawn by lot; legal recourse is excluded. The draw will take place on the day specified in the prize draw. The tickets will either be sent by the Organiser upon request or collected by the participant.

§ 8 Obligations
The participant undertakes not to publish any unlawful content on the prize draw page. The participant also warrants that they hold the rights with regard to the publications. By participating, the participant grants the Organiser the right to publish their name and profile picture and further permits contact via Facebook.

§ 9 Severability Clause
Should individual provisions of these conditions be or become invalid or contain a regulatory gap, the validity of the remaining provisions shall remain unaffected. The invalid or missing provision shall be replaced by a provision that comes closest to the economic purpose of the contract according to an objective interpretation.

§ 10 Reservation of Amendments
The Organiser is entitled to modify the prize draw with regard to its design or special conditions.
